Our general TOS (Terms Of Service)

In contracting SonnetUK to provide web services to you, you acknowledge that you have read, understand, and agree to fully abide by our General Terms of Service as listed below, as well as any other policies relevant to your engagement of SonnetUK.

Definitions & Preamble

The following definitions apply to this Terms of Service agreement:
- "We", "us", "our", "the company", "Sonnet" and "SonnetUK" refer to SonnetUK LTD, representing also Sonnet Design and Sonnet Hosting.
- "You", "your", "customer" and "client" refer to the person or company ordering the services or any other party acting on the customer's behalf.
- "Services" and "service" refers to web services and customer support and any other service or facility provided by us to you.
This agreement shall be governed by and construed in accordance with English law and you hereby submit to the non-exclusive jurisdiction of the English courts.
Headings are included in this agreement for convenience only and shall not affect the construction or interpretation of this agreement.

Billing & Payment

SonnetUK reserves the right to change the advertised prices of any of its services at any time.
All payments will be made in UK Pounds (£) Sterling.
We accept the following payment methods:
- Debit and credit card transactions are carried out by WorldPay on our behalf. All payments through WorldPay are made in UK Pounds Sterling, with any currency conversions being made by the cardholder's bank or lender.
- We also accept payment by personal or business cheque, Nochex, bank transfer/standing order and direct deposit. These payment methods are only available to persons resident in the UK with a UK Pounds Sterling bank account.
- We accept payment by PayPal in UK Pound Sterling ONLY. We may, in exceptional circumstances and entirely at our discretion, accept payment in US Dollars or Euros via PayPal.
If you pay by personal or business cheque and your cheque is returned by the bank as unpaid for any reason, you will be charged a "returned cheque" fee of £30 to cover our costs.
We will not be held liable for any bank charges or administration costs accrued by you in providing payment to us.

Cancellation & Refunds

Please see the relevant service specific Terms of Service or your contract for cancellation terms and information.

Limitation of Liability

In no event shall SonnetUK be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.
All conditions, terms, representations and warranties relating to the services supplied under this Terms of Service agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in this Terms of Service agreement and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded, subject always to the following: Nothing in this Terms of Service agreement shall exclude our liability for death or personal injury resulting from our negligence.
Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the services shall be limited to the charges paid by you in respect of the services which are the subject of any such claim.
In any event no claim shall be brought unless you have notified us of the claim within one year of it occurring.

Indemnification

You agree to indemnify us and keep us indemnified and hold us harmless from and against any breach by you of this Terms of Service agreement, and any claim brought against us by a third party resulting directly or indirectly from the provision of services by us to you and your use of the services including, without limitation, all claims, actions, proceedings, losses, liabilities, demands, damages, costs, and expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of this Terms of Service agreement.
You agree that this indemnification extends to all aspects of your account or commission, including but not limited to website content and domain name selection.

Changes to Terms of Service

SonnetUK reserves the right to change this Terms of Service agreement at any time and without notice. However, notification of changes will usually be posted on SonnetUK.info and/or our customer forums in advance.
We recommend that customers review this Terms of Service and our other policy documents regularly.

IN ORDERING WEB SERVICES FROM SONNETUK LTD, YOU SIGNIFY YOU HAVE READ, UNDERSTOOD AND AGREE TO COMPLY WITH OUR GENERAL TERMS OF SERVICE AND ANY OTHER POLICIES WE SPECIFY AS BEING RELEVANT TO YOUR ENGAGEMENT OF US.
